4. Purpose of processing Personal Data

The basis for a Personal Data File is the factual (either business or other co-operational) relationship between the Registrar and the Registree. The Personal Data File is used (1) for establishing and executing a business or other contractual relationship; (2) for contacting potential new clients, as permitted by the current law, through direct marketing, campaigning, opinion polling, market research, and other purposes requiring addressed contact; and (3) for purposes with an explicit, bespoke approval by an Internet web site user or for those purposes permitted in a contractual agreement between a client and Efecte Corporation.

5. Data contained in the Personal Data File

The Client Register contains the following data:
- name of corporation
- name of contact person
- address and other contact details

In addition, the Personal Data File holds a short business summary, including the following:

- line of business
- number of staff
- number of business locations
- general information (eg. turnover, etc.)

6. Statutory Data Sources

The data sources of the Client Register are: on-line registration data (eg. through enrolment for events, enrolment as service users, requests for additional information), data volunteered by a corporate or private client, and data obtained by Efecte staff during a business relationship. Efecte may use data offered by a third party service provider, eg. Bluebook, in order to update personal data held in its file.

7. Statutory Release of Information to Third Parties

As a general rule, Efecte will not release Personal Data held in its client register to third parties. Contact details may be released to a third party provided that the client has, on the basis of a supply contract (section 15: regarding publicity) or other written or verbal agreement, given consent for Efecte to use its corporate name and details as a client reference.

8. Data Security and Storage of the Personal Data File

Electronic Data has been secured through user identity codes and passwords that will deny unauthorized persons access to data.

Manual Data is kept in a fireproof and locked archive. The data will be destroyed in accordance with the requirements of the legislation concerning data protection.

9. Data Subject’s Right of Access to Personal Data

According to Section 26 of the Personal Data Act, each person entered in the Personal Data File has the right to inspect his/her own details therein. Each person wishing to access such information should submit a relevant written application to the Registrar. The application must be personally signed. Upon receipt of the application, the Registrar will supply the information to the Registree by specific mutual agreement or will grant the Registree access to its premises in order for him/her to carry out the inspection.

10. Data Subject’s Right to prohibit Processing

The client has the right to prohibit the release and processing of his/her data for the purpose of direct advertising and other forms of direct marketing.
